Failure to timely file a Form 941 and pay any tax due may result in a penalty of 5% of the tax due with that return for each month or part of a month the return is late. The CARES Act added the Employee Retention Credit (ERC), another employer tax credit for certain businesses affected by COVID-19, as well as other payroll-related items.
